Flourish Creation Labs Licensing Terms and Conditions

At Flourish Creation Labs, we are dedicated to supporting creators with high-quality designs that fuel both creativity and business success. By purchasing and using our designs, you agree to the following licensing terms, which aim to protect the originality of our work while providing flexibility for your creative endeavors.

1. Definitions

Design: Refers to any creative element provided by Flourish Creation Labs, including but not limited to PNG files, templates, or other digital artwork.

Significant Alterations: Must be substantial enough that a reasonable person does not consider the resulting product the same design. Minor changes, such as color adjustments, do not qualify. Significant alterations must include additional creative elements that transform the design into something unique and new.

Physical Products: Includes items like tumblers, mugs, apparel, or other tangible items created using our designs. Digital products are not included under this license.

2. Attribution Clause

Attribution is not required but is greatly appreciated when crediting Flourish Creation Labs. A simple mention helps support our work and spread awareness.

3. Collaborative Projects

License holders can share a single license within their business team or with business partners, provided that the total sale or production units remain within the license limit. If the limit is exceeded, an appropriate license upgrade is required.

4. Extended License Options

If you need to exceed the 5,000-unit limit, an extended license is required. Pricing for extended licenses:

5. Custom Licensing Options

If your project exceeds the unlimited tier or involves a unique use case (e.g., a non-profit initiative), please contact us at hello@flourishcreationlabs.com for custom licensing options.

6. Updates to Licensing Terms

Licensing terms are reviewed periodically. Any changes to the terms will be communicated via email to all existing license holders to ensure transparency.

7. Prohibited Uses

To protect the integrity and originality of our designs, the following actions are prohibited:

Reselling or redistributing designs in their original or unaltered form.
Offering designs as freebies or giveaways.
Using designs as part of logos, trademarks, or corporate branding without prior written consent.
Creating digital products using the designs unless significant alterations are made (e.g., adding substantial creative elements). Minor changes, such as resizing or color adjustments, do not qualify.

Examples of Prohibited Uses:

Offering the design file as a free download on your website or social media.
Reselling the design file as-is on digital marketplaces like Etsy or Creative Fabrica.
Printing the design on physical products and selling more than 5,000 units without purchasing an extended license.

8. Licensing Transfer Requests

Licenses are non-transferable except in very limited circumstances, such as the death or sale of a business. Transfers require a formal request and a processing fee of $11. Please contact hello@flourishcreationlabs.com for assistance.

9. Refunds and Returns

Due to the nature of digital products, all sales are final, and no refunds will be issued once the files have been downloaded.

10. Grace Period for License Upgrades

You are responsible for monitoring your sales to ensure compliance with the license limits. If you exceed the 5,000-unit, 10,000-unit & 20,000-unit limit a 30-day grace period is provided to purchase the appropriate extended license.

11. License Termination and Enforcement

At Flourish Creation Labs, we are committed to protecting the rights and integrity of our designs. Violations of these licensing terms may result in the following actions:

Warning: A formal notification will be issued to address the violation.
License Termination: If violations continue or are severe, your license will be automatically terminated. Upon termination, you must:
- Immediately cease all use of the design.
- Remove the design from any current or future projects.
Legal Action: In cases of repeated or serious violations, we reserve the right to pursue legal action to enforce these terms in cases of repeated or serious violations.

By complying with these terms, you help protect the originality of our work while ensuring your own success as a creator.

12. Industry-Specific Restrictions

Our designs should not be used for:

Offensive, illegal, or derogatory projects.
Applications involving logos, trademarks, or corporate branding without permission.
